38. Subject to sections 40.1 to 44, a person authorized to act in a participant’s name may not make a transaction request to have ownership of a security transferred to the person, except if the person is the sole shareholder of a legal person participating in Épargne Placements Québec or a shareholder of such a legal person in respect of which the other shareholders and directors have expressly consented to the transfer.
